The Design Works offers web design, website consulting, digital marketing guidance, Google Business Profile assistance, and related creative services.
All services are provided on a project-by-project basis, outlined in a written proposal or agreement before work begins.

We reserve the right to refuse or discontinue services if a project is not a good fit, contains inappropriate material, or conflicts with our business policies.

2. Client Responsibilities

To complete a project, you may be required to provide:

• Content, images, and materials relevant to the project
• Access to hosting, domain, or third-party accounts (where applicable)
• Timely feedback, approvals, or decisions

You are responsible for ensuring that any content you provide:

• Is accurate and lawful
• Does not infringe upon copyrights or intellectual property rights
• Does not violate privacy or contain prohibited content

The Design Works is not responsible for delays caused by missing information or late approvals.

3. Fees, Payments & Refunds

Pricing for services is outlined in your personalized quote or agreement.
Deposits, payments, and due dates will be clearly stated in your proposal.

• Deposits are non-refundable, as they reserve time and resources for your project.
• Work may pause if payments are overdue.
• Hosting or domain fees (if applicable) are billed separately from design services.

Refunds are considered only in exceptional circumstances and at our sole discretion.

4. Ownership & Intellectual Property

Upon final payment:

• You own the content, images, and materials you supply.
• You receive full rights to the final website files, layouts, and content created for your project.
• The Design Works retains ownership of: design tools, frameworks, and proprietary methods; reusable components, templates, and development systems; any licensed software used to build your site (Bricks, ACSS, plugins, etc.)

Licensing for third-party tools is governed by their respective terms.

We reserve the right to display completed projects in our portfolio unless otherwise agreed in writing.

5. Website Hosting & Third-Party Services

If you choose to host your website elsewhere or use services such as:

• web hosting
• domain registrars
• email providers
• plugins
• social media platforms
• Google Business Profile

you acknowledge that these are third-party systems outside of our control.

We cannot guarantee:

• uptime or performance
• email deliverability
• third-party platform availability
• plugin or theme functionality
• actions taken by hosting providers

We will make reasonable efforts to assist you, but ultimate responsibility for third-party systems remains with the provider.

6. Website Performance & Search Results

While The Design Works employs best practices, we do not guarantee:

• specific search engine rankings
• immediate SEO improvements
• certain traffic levels or conversion rates
• Google Business Profile placement or visibility

Search engine optimization, content performance, and search ranking depend on many external factors beyond our control.

7. Confidentiality

Any information you share during the project will be kept confidential and used only for the purpose of completing your project.

8. Limitation of Liability

To the fullest extent permitted by law, The Design Works is not liable for:

• lost profits
• business interruption
• loss of data
• third-party service failures
• security breaches beyond our control
• consequential, incidental, or indirect damages

Your use of the Website and services is at your own risk.

9. Termination

Either party may terminate a project with written notice.
Any work completed up to the termination date must be paid for in full.

10. Changes to These Terms
